ARCHITECTURAL REVIEW PROCESS

GENERAL INFORMATION FOR CONSTRUCTION ON OR MODIFICATION OF LOTS

 

  • It is not necessary to get approval from the Architectural Review Committee when replacing “like for like” that do not change the footprint of the house and do not significantly change the appearance of the property.  o For example, if a homeowner were replacing windows, the new windows would have to be the same size, the same color and in the same locations of the previous windows. However, the homeowner would have to get approval if the location of a window was changed, or if the window was being changed from double-hung to a bay window.

o If a homeowner is unsure of whether they need to submit an application, they are encouraged to contact any member of the Architectural Review Committee for guidance.

 

  • Structures considered Accessory Dwelling Units (ADU’s) or Separate Independent Dwelling areas (whether physically attached or not), not sharing a common wall or directly accessible to the main dwelling are not permitted. The ARC will determine if and proposed structure meets either of these conditions.

  • Detached outbuildings, such as sheds, detached garages, workshops, pool houses, pergolas and gazebos, are permitted within the strict conditions and guidelines stated in Declarations of Restrictions amended, approved and certified with Sussex County, Delaware on 10 June 2026.

    • The following are the minimal conditions which must be met before applying for a detached structure. Note that meeting these minimal conditions does not guarantee approval by the ARC.

      • Maximum Size: 256 sq ft, Maximum Height: 15 ft.

      • Materials of Construction: Architecturally compatible materials (siding, roofing etc) and color to the main dwelling. Metal or plastic sheds are expressly prohibited. Pergolas and Gazebos to be evaluated on an application-by-application basis by the ARC for possible exemptions from the above.

      • Minimum Setback from Property Boundary: 10 ft

      • Location: Behind the rear boundary of the main dwelling

      • Usage: Used solely for residential accessory purposes

  • Builder signs are not to exceed 2’ x 3’ in size, and no more than two (2) signs per lot are allowed. The signs must be removed within two weeks after the work is completed.

NOTE: Arnell Creek HOA regulations and restrictions can be enforced beyond those listed in local State, County & City codes.
